FW: Back up problems

Hi Jerry, Brian,
The email below contains a list of Brian’s current problems. Just to keep you guys informed I receive an average of 2 calls a day from Brian and 2 emails. He’s understandably aggrieved that our s/w doesn’t quite work as it should but he’s also trying to fudge what the initial requirements were so he can get admin work done for free. The notion that we were going to provide a zero-administration system is laughable. Nowhere is this mentioned in the project description.

I’m completely pissed off & fed up with this project & I know that you guys are too. Brian is more than willing to demand what money he has paid back if we don’t get the s/w to work & he’s eating up my time with his calls and queries. I cannot provide him with a support contract YET as we clearly haven’t delivered the s/w or configuration we promised (i.e. it doesn’t work properly yet) & he could legitimately claim this was the case. Also, I can assure you guys that a court case over a €4k s/w project is not the best way to make a successful s/w & IT business in Ireland. He knows that only too well. In our defence he’s clearly reconfiguring the system using inexpert knowledge, therefore making it more difficult to fix his problems. However, it’s clear that we ABSOLUTELY MUST fix his installation if we are to move on.

Regarding payment for the project. SecureNetworks have paid part of the fee and categorically refuse to pay the rest until they are satisfied. I’ve paid VAT on the project and made a partial payment to Brian White. I’m out of pocket by almost 500 euro so far. I cannot pay anybody anything else until I receive full payment from Brian Carroll & valid invoices from you guys. It’s that simple. My audit is coming up and I’ve been told that no under-the-counter payments will be permitted (e.g. you guys have got to produce legitimate invoices for me for your full amounts, don’t care where they originate from. Also, Legitimate invoices only need to include VAT if you’re registered. Small traders don’t need to be)

Apologies for the harsh tone of this email but my inbox over the past few days is full of queries & complaints about the system and few of these are my fault. I have spent hours working with Brian Carroll and it’s just not possible to continue this. Equally, I can’t ignore him or charge him more as some of his grievance is justified.

Therefore I’d very much like you guys to do me a BIG BIG favour and respond to Brian’s emails yourselves on the following matters:
1) Getting the backup script and email config to actually work. If it doesn’t work then inform him why and tell him how to fix it. Any other work ISN’T covered by the project description and we’d require extra payment to do it. (fee of €65/hour) Simple as that.
2) Getting the s/w to work. This means ensuring that camera access can be set consistently. That features and capabilities are explained and documented and that the streaming works. I know that I have some work to do on the latter point but I don’t have any time to do it right away so if Brian can investigate potential problems with the activeX control/server I’d greatly appreciate it.

2. Also Can do please advise list of database files and any other key data
files in the Home Directory (with directory and location name details )
that need to be backed up (daily/weekly etc) as the configuration.rtf file
does not make this clear.

files in the /home directory.. didn’t know there were any?

3. I did a manual Yast online update, which indicated that this was first
update request. My understanding was that Gerry was to set up on auto basis.
How should we set up to do on auto basis?

Not sure where this “understanding” arose. This is NOT covered by the contract.

4. CD Rom Burner is not installed, Can you please advise on drivers and how
to configure.
Not covered within the fee.

5. Can you advise if Mail Transfer Agent in Network Services is the right
utility for activating Mail Server as I tried to change settings to reflect
incoming and outgoing Servers to match my Service Provider settings however
this still doesn’t allow “forgot password” emails to be sent.

God knows what configuration changes were made. However, this is within the project description and we MUST help him on this point.

– Details on how to create the bootable ISO images of the machine..
1. When the machine is fully installed go to the /home/mkcdrec directory
2. Type make
3. This should give you the option to create ISO images of the machine and
put them in the /tmp/… dir Select this option.
4. When the images are created then move these ISO images from the machine
and burn copies using s/w such as Nero or similar CD creation tools.

Data Protection in Ireland and Business Continuity

Both are two subjects that I’m becoming very interested in recently. In trying to develop a clear understanding of all the implications of National (Irish), European and World Market (US, predominantly) data retention legislation I’ve been having a look at the Irish Data Protection Act. More information is available at the authoritative DataProtection Commissioner’s website. However, the following point struck me.
Section 2 of the original 1988 Act (which is still valid AFAIK) states that

A data controller should observe certain principles in relation to personal data:

  • The data or information constituting the data shall be obtained and processed fairly
  • the data shall be accurate and where necessary kept up to date.
  • Data held for back-up purposes is exempt
  • shall be kept for one or more specified or lawful purposes – specified refers generally to purposes specified in any registration document, where applicable
  • shall not be used or disclosed in any manner incompatible with such purpose(s)
  • shall be adequate, relevant and not excessive in relation to that purpose(s)
  • shall be kept for no longer than is necessary; data held for historical, statistical or research purposes is exempt.

What’s worrying me is the point in bold print. The problem isn’t whether this data is currently used as part of a live data set but what happens if data that does not meet the terms of the act is restored, after information system loss or damage. The nature of some database and structured data records means that offending data WILL ALMOST CERTAINLY have to be restored from an incorrect archive AS LONG AS IT’S IN THE ARCHIVE IN THE 1ST PLACE. It’s a subtle point but surely, the onus should be on companies to ensure that they always have a backup or archive that contains only non-offending data that doesn’t breach any part of the act. Therefore, backup policy MUST be affected by this act.

Hiya Tom,
As you know I’m working in the area of Information Lifecycle Management and
data retention/availability legislation. When reading the Sarbanes Oxley
(SOX) act of 202 and I realised that the following aspect of the law effects
your business (dramatically)…
SOX applies to all US companies which are quoted on any of the US securities
exchanges and relates to the controls and processes involved in their
financial reporting mechanisms.

Section 409 of SOX (SOX409), which is not yet in force, will soon require
real-time public disclosure of all events that could materially affect
company financial performance. To comply with this rule, companies will
first have to recognize in real-time that significant events have taken
place (e.g., a cash-flow problem), and then get that information into a
public reporting system.

The implication for your business is obvious. Both US companies and European
subsidiaries of these companies MUST provide real-time press releases and
public dissemination of all information which COULD impact on the company’s
financial performance. NOBODY to my knowledge is developing a PR system
specifically catering to this need. I can provide some useful contacts for
you if you wish to follow this up. I may even be able to refer you some
business or provide some SOX consulting 😉
